Kinda. The construction company is in house for the water park, and is only there to build and design the park's rides. It's Henry and Sons Construction Company. They really are going after the overall company, owners, and designers.

This has turned into nothing more than a witch hunt, absurd.  Schlitterbahn is one of highest regarded(or atleast was) waterpark chains in the country and has decades of experience designing and building slides. 

I ain’t saying someone shouldn’t be held accountable for the accident but it isn’t like they just designed it in RollerCoaster Tycoon and opened it.

A 168 tall water slide with an up hill part not even a third of the height in a vehicle which has no way of staying on the slide (such as upstop wheels)?  Sounds pretty close to a RCT ride that you'd design if you wanted to kill the guests.  Sure they added magnets and height to the uphill portion, but that sure didn't do enough.  Even boats launching off the slide didn't prevent it from opening.  That's just sheer negligence.

The indictment can be read here. It’s worth reading, especially before commenting on this. Schlitterbahn might be highly regarded, but that doesn’t mean that they didn’t negligently design and operate Verruckt.

As @silver2005 explained, that's actually a very accurate analogy to what really happened. Please read the indictment all the way through before jumping to conclusions. There is a ton of eye-opening stuff in that document.

The Weinstein Company was highly regarded till the world found out what a douchebag Harvey was. 

 

And they completely skipped the engineering on the ride and ignored the experts who told them it was dangerous. Reading the indictment, they actually might have been better off using RCT to design it.

"This appears to be nothing more than a malicious effort on the part of the State to stir up unfounded fear and cast doubt on this company in the wake of the tragic accident in 2016."

"False impression" of "operating [...] in an unsafe manner"? "Malicious"? "Unfounded fear"?

I have no further comment, except to say that you won't find me at Schlitterbahn for a VERY long time. If ever.

Been a while since there was an update here.

A few things of note from this article and articles it links to:

One, all criminal charges were dismissed in February due to abuses by the prosecutor in the grand jury process, namely use of inadmissible evidence.

Two, Schlitterbahn Kansas City stated in August in a Facebook comment that all 2018 season pass holders would get a free 2019 pass, after complaints of unusually high amounts of downtime.

Three, Schlitterbahn Kansas City appears to have decided to not open at all in 2019. I checked their website, which simply says "Check back for 2019 tickets", and clicking on the buttons to buy tickets or season passes does nothing. Other locations appear to be operating normally. The Kansas City location's Facebook page has also been dormant since October.
