After they had the guy up in the lift, little to no movement on the cranes. I have to head to Columbus for the day now so expect quite a bit to get done, I know I am.

Yea screw you weather. going to Cincinnati is always a struggle at Christmas time coming through erie.

There is no difference between a drone and an airplane in regards to the laws with the pictures.  KI has a rule you can't fly a drone from their property. As a land owner you can do that. What has happened is the park and this site have decided they get to control the land around the park and the airspace over it, which has no legal bearing.  If you were standing on public property flying a drone over Kings Island, they could call the cops and the cops have exactly zero recourse. Period. That is the law.  Only people who could do anything is the FAA, and unless you are creating a hazard to others, i.e. in airspace, over crowds, etc. they will not do anything about it. Wont even send someone out to investigate.

The footage was legal. The park has a rule of no flying drones from there property, they can claim over but it has no legal standing,. KIC has agreed after advice from park management to not allow drone footage on this site as per the ToS. KIC has every right to do that even if taken legally. If you have footage from a drone you want to show people, you would have to post it elsewhere.  IMHO it is silly of this site to not allow it as they are making the choice to drive traffic elsewhere, but that is KIC's decision to make. I would counter that Kings Island rules are less restrictive then the law as they can not keep you from doing something legal off their property even if they claim they can. They have every right as the land owner to forbid drones from their property, but if launched and recovered from somewhere else, that the pilot has legal permission to be on,  the park can't do anything about it. Local cops don't have jurisdiction, not state patrol. Heck the DEA could come out and tell you to stop and you don't have too until the FAA themselves get involved.   I looked up with the FAA on any incidents involving drones around Kings Island, I could not find any.  I couldn't even find a news article of an incident. I am not sure the statement that many flying drones around the park are breaking FAA rules is factual. I am certain the part about local laws is not a factual as no city or township can make laws about drones other then to ban them from their property (federal preemption).  

I do agree that KIC has every right to ban drone footage from the site. It is in the ToS which everyone agreed to when they signed up. It is a legal contract. I think it is a bad policy IMHO as you are now driving traffic from your site to other sites. But that is a business decision for someone other then me to make.

No laws were broken. A site policy was broken as they ToS state no drone video, right wrong or indifferent that is the policy we all agreed too.

They can (and do) revoke season passes, letting the user know they're no longer welcome on the park's private property. FAA rules and local laws notwithstanding.

I didn't say that flying drones around the park is a violation of FAA rules in and of itself.

Many property owners consider it trespass to launch or control a drone from their property without permission. Local laws can also affect using some types of public property, such as road right-of-ways, for that purpose.

FAA rules do apply, mainly with respect to registration, staying below 400', staying within a line of sight, and not operating in a careless manner. Some people who have flown drones near or over the park have not fully complied.

All drones (Unmanned Aerial Systems) are prohibited at (in) all Cedar Fair parks, including Kings Island, and any unauthorized drone(s) observed over Kings Island will be reported to the FAA and local law enforcement, regardless of its point of origin or operation.

Aside from what is seen above, the footage does go over KI property & quite possibly over 400 ft. due to looking down at both the construction cranes & ET.
 
That being said, splitting hairs to argue just for the sake of argument is pointless when it comes to KIC.  If the park considers it wrong, then it is wrong and KIC will only be on the losing end.  It's just not worth it.

No matter the FAA laws, since the park has this drone policy in place, KIC will be good stewards in following them. 

 

Back on topic: Weather shows it to be a little windy today (SSW 14 mph) I wonder if that is a contributing factor?

Yeah it is windy down here. I live close to the park and I took my dog for a walk this afternoon and it was windy and I can hear our wind chimes outside pretty well.

Hope this is not too for off topic . . but here is some aerial footage of The Beast a year after construction and the land next to The Racer where ORION is being built.  The subject of the video says 1979 but as someone pointed out in the comments they do not see the SkyRide which was removed after 1979.  So the video is most likely from 1980.  Can see some of maint building that ORION is going to ride over.

I guess back then even The Racer felt like you were going back into the woods on the turnaround.

Also the 2nd and 3rd tunnel are connected as the 2nd tunnel which wasn't added until later.

Dude, the park is over 700 acres, he was way, way into park property. Park policy was broken.

It was fairly calm this morning which started promising and then everything ceased. Some of the work they did the past two week surprised me due to those conditions seemed to be less than optimal so it has become hard to pattern.

 

With that said, the lighting was more favorable this morning, I pictures with  the guy in the lift and with wind seeker parked at the top I may share later.

Agree....but if they are clowning us....its an amusement park after all (Maybe we should provide Kings Island and the construction crew with some amusement for once! LOL), then that would be so great too. Heck I was watching the vid feed while I was on a mini vacation in Chicago!  I loved it!  But a good clowning....priceless!

Right.  I think that's what @PilotDude was saying.  They can't exactly throw you in jail for flying a drone above a certain height over private property (generally, many exceptions apply) but it's the park policy not to.  However with it being park policy they can ban you or reprimand you or whatever for violating their policies.  Kind of like how they can't really press charges for line jumping but can certainly kick you out of the park for it.  KIC's policy is good on this as they shouldn't allow things that are blatant disregards to park policy.

I wonder how they would go about banning you? It’s not like you would have to give an ID if they caught you doing it from off site as it’s not illegal. Would they have a wanted poster in every ticket booth? I wondered this to when the young ladies were thrown out for flashing at the World Series game and subsequently banned from all stadiums. Seems like a very empty threat.

Oh they can and do post pictures. They can easily keep you from buying a pass or revoking one already in use. You'd have to buy a paper ticket likely costing you more and depending on how bad the transgression if seen you'd be escorted out.  Depend how far the park wants to go to keep out unwanted guests.  You can be trespassed since most parks operate on private property therefore if caught it becomes even more a deterrent because law enforcement can get involved then.  It can and it does happen and they have systems in place to enforce it.

Not sure why you are so concerned about this. He hasn’t done anything illegal. He seems to have a legit photography business and this was likely to get clicks to it. I wouldn’t personally do it because I don’t have a drone or drone license but he’s free to do what he wants legally. Just don’t post it on KIC.

I’m concerned since a moron is giving enthusiasts, who do follow the rules, a bad name. Just because the person doing it is a business owner doesn’t mean they can ignore the rules of other companies.

The fortunate thing is the park knows exactly who that guy is and already don’t like him, so every time the sh-t hits the fan for that guy KIC doesn’t necessarily get splattered.
