  5. WOW!!!!! great report , now that it is all over....did she have any ongoing workers comp claim that was ever brought up in court? i over heard co-workes talking about this case and just wanted to comfirm it.
  6. Yes. Actually, the answer to that question is confidential. The park MAY be totally self-insured. No reference to an insurance policy for this has been seen in public documents in recent years.... ahhhhhh...ok ......even if there was insurance involvement.....holy cow i wonder what the deductible would be per claim? If the park was insured for such an issue that is not as much of a hit for the insurance company. Now granted, it's not fun to write out a check in those amounts .... but if it's the parks as a whole ... it's a hefty chunk. The one thing that is pretty evident is that this will have an effect on SOB and it's operation or lack there of. understood......next question......you know how if you have too many tickets, or accident with your auto insurance?....and they can drop tou as a client?......could that happen to CF (KI).?

  17. Juries, when there is one, decide the facts. The judge can only decide the case if, taking all the facts in favor of the opposite party, there is no way that can win. That would be called a "summary judgment." So, yes, the judge can decide the matter at the conclusion of either side's evidence, but it is unlikely. In some states, when a summary judgment is entered that late in the case, the jury is "directed" to return such and such a verdict, but that is far more common in criminal than civil cases. As for windshawne, parties with special knowledge of the facts of a case are normally either not allowed to serve on a jury or are stricken by one side or the other using one their "pre-emptory" challenges. Exactly.   18. I understand what you are saying, but there is a small problem with only one part. Lets say, just for a case of argument, the lady does have some sort of degrading hip injury. This injury was caused by the ride, and in an extension the park. How is it fair for the lady to only get initial costs of the hospital visits and not further medical damage caused by the ride/park. I understand if she is faking, and as they say it will all come out in the wash, she deserves nothing, but if she is in as much pain as she says she is then the park should be held responsible to the fullest extent possible. Now some doctors can say "if you have to have your hip replaced now, the average life span of a joint is X amount of years. They can then take the expected life expectancy of this woman and subtract the life expectancy of the hip joint and get an average guess on how many hip replacements she may need. Think brakes on a car. Life expectancy is on average 30-45 thousand miles. But if you brake hard then they wear out much quicker, brake softer last much longer..... what were the 26 other ppls injuries?? Also didnt that lady have a prior workers comp case for a work related injury? i heard a few co workers talking about the case at work and over heard them talking about it.
  19. if a wooden coaster has steel supports can we truely call it a wooden coaster?? did historical wooden coasters have steel other then the track or rails? if steel is needed to support the thing then that tells me that the designers are trying to get the coast to do somthing it shouldnt do. Just my opition.
  20. IMO when themes break down at the cf parks they just dont fix them.......if you want examples just ask.
  21. good thing she wasnt jogging, running, doing the stanky leg, jumping jacks, or arobics that day.....if that was on video she would have been torn apart in the court room.
