Where did they come up with that number, I think his attorney is trying to make some $$ on this one!

He won't win its not going to happen nobody else had filed suit and another thing is that this is just like the guy trying to sue Kings Island for $10M about being roughed up by park secruity guards ha!

And unfortunately, most plaintiffs settle these losses for some type of monetary funds. You wonder why prices and insurance tend to be so high some times? Take a look at all the attorney commercials on Jerry Springer. It all breaks down to lowest ultimate cost. Normally it's far less money to just throw some money at someone and have them go away.

While that amount is very excessive, It really is not a shock that a suit has been filed.

Quite honestly, if I was paying $250 to $520 a night for a room at GWL, and something they did (or didn't) do got my family sick, I would hope that GWL would compensate me so that a suit would not have to be filed.

And what I mean by compensation is along the lines of the current stay being taken care of along with another weekend. While some people may consider that excessive, the way I look at it is: my first vacation to the lodge was ruined by getting sick, I believe I deserve another opportunity.

This lawsuit is worth next to nothing in terms of money. Apparently, there is an attorney or law firm out there that is REALLY hurting for business!!!!!!

Could you be talking about the Raven accident at Holiday world in 2004?

I could understand this case if the guy died...but maybe he just had a little too many drinks at the bar!

Being that we don't know what was or was not offered prior to this individual filing suit, I find it difficult to imagine that the guests were not offered a free stay. (And that even with the investigation being Inconclusive)

Could you be talking about the Raven accident at Holiday world in 2004?

a. at Holiday World, it was a she who died by exiting Raven after it left the station but prior to its return thereto.

b. She wasn't a teen.

c. The exact details of how and why this happened are not known.

It was not the Raven, I think it was Shockwave @ Kings Dominion, but I could be wrong because i just heard it somewhere.

Yes, that did happen at Shockwave at Kings Dominion, but it also has happened at other parks as well. There is an argument to be made that ride restraints should restrain even those who either want to get out or panic and try to get out without appreciating the danger--and perhaps even those who are just trying to get out and do appreciate the danger. There is a contrary argument that those who ride dangerous devices like roller coasters should know the dangers and appreciate the risk and assume at least part of that risk, absent gross negligence by the park and/or ride manufacturer. At one time, the latter was the law in this country (and still is in many parts of the world). Currently, the former is much closer to the law in this country...thus the reason why rides have been slowed, restraints made more confining, etc. Parks must protect themselves and their patrons from lawsuits...and, to be fair, society's safety standards have also greatly increased.
