  1. I am not claiming to be a wealth of knowledge on jury trials and cases but I have a question for anyone who may or may not be one.... does this ruling have any bearing on future cases. The jury ruled that KI was in fact responsible for her injuries, which means in future cases the people who sue just have to prove they have accumulated that much debt over the injuries. So would that mean their cases have become easier? Does this sort of thing make CF want to settle more quickly? or Will this case have no bearing on future cases involving the other people?

Although I don't agree with everything involved in this case, I'm happy to see the lady wasn't awarded anything monetarily that would of been over the top, as in a 6 figure settlement. It could of been a lot worse. for whom? Worse for you the average park goer? worse for the park that it would have to pay her money for riding a ride at their park that broke? worse for the lady who, may or may not, be able to continue a 100% normal life? remember folks there are still a few people out of the 28 people who have not settled...... Personally I think she got about what she deserved, money to pay her bills and heaven forbid, if she needs a hip replacement she has the money to do it, even if someone posted earlier that she may not need it - arthroscopic may be all she needs. Either way be glad you were not on that train when it all went down.... Not sure what your trying to say, as I was just typing a general blanket statement that it could of been worse for the lady of topic, and for the park, or any other under lying synonym I may have missed. Usually, the average park goer doesn't surf fan sites such as KICentral, pointbuzz, or anywhere else for that matter, IMO. I beleive you may have taken my post the wrong way. To each his/her own I suppose. Although, I do wish her the best of luck, hopefully she will lead a 100% normal life, or anyone else injured for that matter. No I didnt take it the wrong way, I meant it more as in subtle sarcasm, of who it could have been worse for.... I mean I wouldnt want to be anyone involved with this case or were involved with this case. Too many variables and the park paid, the lady paid, the average park goer will pay or has paid..... and the "be glad you were not on the train.." comment, I meant more for everyone, as in "Hey at least you wernt on the ride that day or it could be bad for you" type thing. No harm bro....

  5. The jury, who were presented with the real facts of the case, apparently did not think she was faking. And when did lawyers ever want anything other than money? And if I am correct she didnt wait for two years to sue.... Usually things take time to go to court. I could say I want to sue Dakota for hitting me with a car. Well that wont go to court right away. I will have to get done with my medical treatment. Doctors from both sides have to look me over. A court date has to be set. Both sides meet. One side asks for an extension, new evidence is presented. It does not work like in Law and Order. Civil lawsuits usually take some time, sometimes 3 years. I had a family member that sued a hotel because of their negligence. After 3 years they settled out of court for medical bills and some pain and suffering (which our lawyer told us was the Hotels way of hoping to keep us quiet about the incident). So guys its not you sue and it goes right to court. The hip replacement issue is a touchy situation also. One person could have a hip replacement that lasts 35 years, and another person has a hip replacement that lasts 5 years. Why is this lady so wrong for wanting to have the ability to take care of herself in the future if she would need it. But its all water under the bridge, some people sue for frivolous law suits and some people have legitimate claims. Remember the McDonalds Coffee incident wasn't because she spilled coffee on herself, but because the machine was broke and heated the coffee to an extreme temperature that caused severe burns when spilled........ BTW dont read the comments section on the Enquirer's website, it will just make you aggravated because people think the lady sued because the ride was rough....

  7. i say lets not attack the woman. To be truthful no one knows the full story except her, her doctors, and her lawyers. Do not pass judgement unless ye wants to be judged, or something like that. Maybe this lady was in too much pain to go on, maybe she faked. Either way she was riding a ride that broke while she was on it and caused her, and about 25 others, some semi-serious injuries. She didnt cause them on her self, meaning she didnt do anything wrong while riding the ride, so lets be gentle on her. She may never be able to enjoy a roller coaster again. And I believe we can all relate to how horrible it would be to never enjoy a certain pleasure again.....

  10. so in the winter is that where the trains normally start? I mean since the transfer track is so high off the ground? is that the first stagiing area? I guess newbies like myself, who dont pay to close attention during closing times of the season, would like to know what is the standard operating procedure, if it exists, on how the rides are winterized.... I have absolutely no idea how Cedar Fair does things in that regard...I know that under previous ownership getting the trains sheltered was of paramount importance. added my emphasis.... nice.... but when you say sheltered do you mean just under shelter just some sort of covering or do they go to a mechanics building our of the elements of cold etc?

  16. I understand what you are saying, but there is a small problem with only one part. Lets say, just for a case of argument, the lady does have some sort of degrading hip injury. This injury was caused by the ride, and in an extension the park. How is it fair for the lady to only get initial costs of the hospital visits and not further medical damage caused by the ride/park. I understand if she is faking, and as they say it will all come out in the wash, she deserves nothing, but if she is in as much pain as she says she is then the park should be held responsible to the fullest extent possible. Now some doctors can say "if you have to have your hip replaced now, the average life span of a joint is X amount of years. They can then take the expected life expectancy of this woman and subtract the life expectancy of the hip joint and get an average guess on how many hip replacements she may need. Think brakes on a car. Life expectancy is on average 30-45 thousand miles. But if you brake hard then they wear out much quicker, brake softer last much longer..... what were the 26 other ppls injuries?? Also didnt that lady have a prior workers comp case for a work related injury? i heard a few co workers talking about the case at work and over heard them talking about it. Hey I am not defending her... just giving an opposing view point, trying to keep things equal... Now if she has a current workers comp case going, well thats not good for her. How can you prove one injury was from what cause, work or ride. About the other injuries.... weird things happen. You could be in a car crash driver and have no injuries while your passenger in the front seat has three broken ribs, but the 2 passengers in the back have head injuries.... so who knows....

  18. good thing she wasnt jogging, running, doing the stanky leg, jumping jacks, or arobics that day.....if that was on video she would have been torn apart in the court room. well some orthopedic physicians suggest walking to keep joints movable, and some places have under water jogging/swimming as post operation rehab..... Now I have no idea what the stanky leg is.....

  20. So the whole KI defense of the case is from one video? Saying she was carrying a bag of groceries, no idea what was in there-could have been cereal and bread, and she lifted her leg up while buckling in her son? Some people can still try to live a normal life 2 years after an injury. The fact remains she may be in pain and she has learned to "deal with the pain." So if I am wrong the lady's lawyer have an "orthopedic surgeon who no longer performs surgery but is an expert on the discipline" while KI has "a former emergency room doctor who works with various agencies on determining when injured people are able to return to work." This does not seem to be a very good person to have in your corner. Thats similar to have a transmission problem on your care and having the tire guy saying you should be fine........
  21. well sadly its always an accident or a freak accident that can doom a ride... but it also leads to better ride designs in the future..... and hip injuries can develop..... sometimes a bone does not break but can bruise... it may take a few days for symptoms to appear, then awkward limping can result to permanent damage.... and then hip replacement.... I am not a doctor but just have been hurt a few times and your body over compensates... so its possible.....
  22. They do use the line for HH. It is now the line for Flight Deck. Instead of closing Flight Deck for HH like they did last year, the line goes through SOB's line, through one of the switchbacks and then one of the silver hand rails are gone, you continue down towards the exit of Flight Deck but right before you start to go over the bridge you take a left (not through the cut through from the exit to the line) and then you are in the line right before you head up the stairs towards the candy machine. Make sense? Probably not but I tried. I think I understand how they are using the line... but does that mean when you are exiting you are cutting through the line?
  23. so amazingly you can not just google Roller Coaster Insurance.... (I dont think Flo from Progressive has a CF aisle...) but if you think about how the calculate auto insurance, its based on driving record, usage, model type etc...... so thats something to think about.... and side note KIC is such a refreshing blog to visit... no real shouting, and no random yahoos spouting off politics or hate speech.... yay for KIC....
  24. Well, I am not a lawyer and I do not play one on tv, but I would think the trials are not hugely important to the future of the ride, unless a CF lawyer feels that this is just the beginning of a future tidal wave of claims..... but yeah I guess they can be added to my mental list......
  25. besides the woman's trial happening... and the random lights on, reported a page ago, has anything significant happened around this ride in the last few weeks? Recapping what I know, and anyone feel free to add to this list as its here to help all who come after us.... Ride shut down. Ride Cleared by state, but remained closed Ride closed for remainder of year, given dreaded SBNO Ride Que is bolted and zip tied closed Signs removed from Que Line Ride was test some time in September Is the above all correct? any additions need to be added? Are they using the SOB Que line for anything to do with HH?
